These Terms of Service ("Terms") govern your access to and use of the PortoPrime website (portoprime.pt) and any related services we provide. By using the site or engaging our services, you agree to these Terms. If you do not agree, please do not use the site.
1. Acceptance of Terms
By accessing or using portoprime.pt or contacting us through the website, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Description of Services
PortoPrime provides premium property-management services to owners of residential property in Portugal, including:
• Short-term rental management under Portugal's Alojamento Local (AL) regime • AL licensing assistance and AIMA / SEF compliance reporting • Renovation and interior-design services • Owner accounting and reporting via our online dashboard • Tax-representation referral through licensed partners
The website provides information about these services and a calculator tool that gives non-binding revenue estimates.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use our services. You must own — or have written authorisation from the owner of — any property you submit to us for management.
4. Owner Responsibilities
When engaging our services, you agree to:
• Provide accurate, complete, and up-to-date information about yourself and your property. • Hold valid title or written authorisation to rent the property as Alojamento Local. • Maintain the property in safe, habitable condition and obtain required insurance. • Pay agreed fees on time according to the service agreement signed separately. • Comply with all applicable Portuguese laws, including tax declarations.
5. Fees and Commission
Our management fees are set out in the individual service agreement signed between you and PortoPrime. Standard tiers are: Essential 15%, Standard 20%, Premium 25% — calculated on net booking revenue. Fees, service tiers, and inclusions may evolve; the agreement signed at engagement governs your specific arrangement.
6. Intellectual Property
All content on portoprime.pt — including text, graphics, logos, images, and software — is the property of PortoPrime or its licensors and is protected by Portuguese and international copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. The "PortoPrime" name and logo are trademarks of PortoPrime.
7. User-Generated Content
When you submit content (photos, descriptions, messages) to us, you grant PortoPrime a non-exclusive, worldwide, royalty-free licence to use that content for the purpose of providing our services to you, marketing your property, and promoting PortoPrime. You confirm you have the right to grant this licence.
8. Disclaimers
The website and our calculator are provided "as is". Revenue estimates, occupancy rates, and yield projections are illustrative based on market data and historical performance — they are NOT guarantees of future earnings. Actual returns depend on property characteristics, market conditions, regulatory changes, and other factors outside our control. We make no warranty that the website will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by Portuguese law, PortoPrime's total aggregate liability arising out of or related to these Terms or your use of our website is limited to the fees you have paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages. Nothing in these Terms limits liability for fraud, gross negligence, or wilful misconduct.
10. Indemnification
You agree to indemnify and hold harmless PortoPrime, its directors, employees, and partners from any claim, demand, loss, or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your violation of any law or third-party right; (c) inaccurate or misleading information you provide; (d) your operation of the property outside the scope of our service agreement.
11. Termination
You may stop using the website at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Sections regarding intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Portugal, excluding its conflict-of-laws rules. Any dispute arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of the District of Lisbon, Portugal, without prejudice to consumer rights of EU residents to bring proceedings in their country of domicile.
13. Changes to These Terms
We may revise these Terms from time to time. The "last updated" date indicates the current version. Continued use of the site after changes are posted constitutes acceptance of the revised Terms. Material changes will be highlighted via a notice on the website.
